1. Terms and Definitions
1.1. For the purposes of these Terms, the following definitions shall apply:
Buyer — an individual who places an order on the Website for the purpose of purchasing goods for personal use not related to entrepreneurial or commercial activities.
Seller — Sole Proprietor (FOP) Manina Alesya Tarasovna, registered in accordance with the legislation of Ukraine.
Website / Online Store — the web resource available at https://eu.maltipooshop.com/, owned by the Seller and intended for the remote sale of goods.
Goods — products, accessories, and related items for animals offered for sale on the Website.
Order — a request submitted by the Buyer for the purchase of Goods, confirmed by payment.
Delivery — the process of transferring the Goods to the Buyer via the delivery service “Nova Poshta” (to a branch, parcel locker, or by courier).
2. General Provisions
2.1. This public offer (hereinafter — the “Offer”) constitutes the Seller’s official proposal to conclude a retail sales contract by means of remote communication through the Website.
2.2. This Offer is a public contract pursuant to Article 633 of the Civil Code of Ukraine (CCU) and a public offer pursuant to Article 641 of the CCU.
2.3. Placement of an order by the Buyer on the Website is deemed an acceptance of this Offer in accordance with Article 642 of the CCU and the Law of Ukraine “On Electronic Commerce” No. 675-VIII dated 03.09.2015.
2.4. By performing actions required to place an order (clicking the “Place Order”, “Pay”, or similar buttons), the Buyer confirms acceptance of the terms of this Offer and enters into an electronic sales contract.
2.5. The Seller is entitled to amend this Offer unilaterally by publishing a revised version on the Website. The new version enters into force upon publication and applies to all orders placed thereafter.
2.6. All relations arising from this Offer are governed by the Civil Code of Ukraine, the Law of Ukraine “On Consumer Protection”, the Law of Ukraine “On Electronic Commerce”, and other applicable regulations of Ukraine.
3. Subject of the Agreement
3.1. The Seller provides the Buyer with the opportunity to purchase Goods on the Website for personal, family, or household use, not connected with entrepreneurial or commercial activities.
3.2. If the Seller has grounds to believe that the Goods are being purchased for commercial purposes, the provisions of the Law of Ukraine “On Consumer Protection” shall not apply, and the relations between the parties shall be governed by the general rules of the Civil Code of Ukraine.
3.3. This Agreement applies to all Goods presented on the Website while the information about such Goods remains available in the catalogue.
3.4. The retail sales contract is considered concluded at the moment the payment is confirmed and an electronic settlement document is issued, which has the legal force of an electronic document pursuant to the Law of Ukraine “On Electronic Documents and Electronic Document Flow” No. 851-IV dated 22.05.2003.
4. Order Confirmation
4.1. If the Goods are unavailable in stock, the Seller shall notify the Buyer by phone or email. The Buyer may be offered a replacement, partial fulfilment of the order, or cancellation of the order.
4.2. Orders are placed through the Website. The Buyer is responsible for the accuracy of the information provided.
4.3. If the Seller is unable to contact the Buyer within 24 hours after the order has been placed, the Seller reserves the right to cancel the order.
4.4. After the order is placed, the Buyer receives an electronic confirmation and information regarding the delivery time.
4.5. The Seller’s obligation to transfer the Goods is deemed fulfilled at the moment the order is handed over to the courier service. The Seller uses various delivery providers, including DHL, DPD, and national postal services of European countries.
5. Goods
5.1. All Goods are accompanied by descriptions and images published on the Website. Minor variations in colour and texture may occur due to lighting conditions or screen settings.
5.2. Personalized items (engraved tags, customized accessories, etc.) are not subject to return or exchange, except in cases of manufacturing defects.
5.3. Minor variations resulting from the natural properties of materials (leather, metal, textiles) shall not be considered defects.
5.4. All Goods undergo quality control and comply with the requirements of Ukrainian legislation regarding the safety and labeling of non-food products.
5.5. If the packaging is damaged upon receipt, the Buyer must draw up a damage report with the representative of the courier delivery service and notify the Seller by email.
6. Delivery
6.1. Delivery is carried out to the following countries:
Portugal; Spain; Andorra; France; Monaco; Luxembourg; Belgium; the Netherlands; Ireland; the United Kingdom; Iceland; Norway; Sweden; Finland; Denmark; Germany; Switzerland; Liechtenstein; Austria; Italy; Malta; Slovenia; Croatia; Bosnia and Herzegovina; Montenegro; Kosovo; Serbia; North Macedonia; Albania; Greece; the Czech Republic; Slovakia; Poland; Hungary; Romania; Bulgaria; Moldova; Ukraine; Estonia; Latvia; Lithuania; the United States; Canada; the United Arab Emirates.
6.2. The Seller transfers the order to the courier delivery service within 48 hours after the order has been placed.
6.3. The further delivery period is determined solely by the courier service. The Seller shall not be liable for any delays caused by the courier service, customs procedures, force majeure circumstances, or incorrect information provided by the Buyer.
6.4. Once the order is handed over to the courier service, all responsibility for the safety, handling, and timely delivery of the shipment passes to the courier service. Until that moment, responsibility is borne by the Seller.
6.5. Delivery may be carried out to the Buyer’s home address specified in the order, as well as to pick-up points or parcel lockers of the courier service, where such options are available.
6.6. After dispatch, the Buyer receives a tracking number to monitor the shipment.
6.7. If the Buyer fails to collect the parcel within the free storage period established by the courier service, the shipment is returned to the Seller. Re-shipment costs shall be covered by the Buyer.
7. Price and Payment Procedure
7.1. All prices on the Website are indicated in euros (EUR), inclusive of all applicable taxes.
7.2. Payment is made in euros using the following methods:
– online payment by Visa or Mastercard (issued by any bank worldwide) via the Ukrainian payment system MonoPay;
– bank transfer to the Seller’s account (Sole Proprietor) upon prior agreement.
7.3. At the moment of payment, the euro amount is automatically converted into Ukrainian hryvnias (UAH) according to the official exchange rate applied by the payment provider. The actual transaction is processed in UAH.
7.4. The Seller does not store card details; all payment processing is performed by certified payment systems in accordance with PCI DSS requirements.
7.5. An electronic receipt sent to the Buyer’s email constitutes a settlement document in accordance with the Law of Ukraine “On Electronic Documents and Electronic Document Flow” and the Law of Ukraine “On Electronic Trust Services” No. 2155-VIII dated 05.10.2017.
7.6. In the event of a refund, the funds are returned to the same card or bank account used for the original payment within up to 14 calendar days.
8. Return of Goods and Refunds
8.1. Returns are processed in accordance with the Law of Ukraine “On Consumer Protection” No. 1023-XII dated 12.05.1991.
8.2. Goods of proper quality may be returned within 14 calendar days, provided that their marketable condition, original packaging, and labels are preserved.
8.3. Personalized goods are not subject to return or exchange, except in cases of manufacturing defects.
8.4. Goods of improper quality are subject to exchange, repair, or refund after a quality inspection is performed.
8.5. In the event of a dispute regarding the cause of the defect, the Seller shall conduct an examination at its own expense.
8.6. Refunds are issued to the original payment method within up to 14 calendar days after the returned goods are received by the Seller.
8.7. If the Buyer does not respond to a request regarding the refund method within 30 days, the goods will be stored for up to 6 months, after which they shall be disposed of.
9. Liability
9.1. The Seller shall not be liable for any damage arising from the improper or incorrect use of the Goods.
9.2. Accessories sold by Maltipoo Shop are decorative in nature and do not replace safety, restraint, or protective equipment. The Buyer bears full responsibility for their use.
9.3. The Seller shall not be liable for delivery delays, technical failures, incorrect information provided by the Buyer, or any indirect, consequential, or incidental damages.
9.4. The Seller’s maximum liability is limited to the purchase price of the Goods ordered.
9.5. Electronic notifications exchanged between the parties are deemed equivalent to paper documents in accordance with the Law of Ukraine “On Electronic Documents and Electronic Document Flow” No. 851-IV and the Law of Ukraine “On Electronic Trust Services” No. 2155-VIII.
10. Force Majeure
10.1. The Seller shall be released from liability for failure to fulfil its obligations due to force majeure circumstances, including but not limited to: military actions, blockades, epidemics, natural disasters, power outages, communication failures, and actions of public authorities.
10.2. The term for fulfilling the obligations shall be extended for the duration of such circumstances.
11. Additional Provisions
11.1. The Seller is entitled to assign its rights and obligations under the contract to third parties, provided that such assignment does not infringe upon the Buyer’s rights.
11.2. The operation of the Website may be temporarily suspended due to updates or technical maintenance.
11.3. The Seller reserves the right to refuse to process an order in cases of abuse of the terms of this Agreement or in the event of repeated excessive returns.
11.4. The relations between the parties are governed by the legislation of Ukraine.
11.5. Questions and claims shall be submitted to the following email address: maltipooweb.23@gmail.com. The response period is up to 5 business days.
11.6. The invalidity of any specific provision of this Agreement shall not affect the validity of the Agreement as a whole.
12. User Agreement
12.1. By using the Website, the User confirms acceptance of this Agreement, the Privacy Policy, and the terms of processing personal data.
12.2. The User undertakes to provide accurate and truthful information when placing orders.
12.3. The User is not permitted to post offensive, promotional, or misleading content on the Website.
12.4. All materials on the Website constitute the intellectual property of Maltipoo Shop and are protected under the copyright and related rights legislation of Ukraine.
13. Privacy and Personal Data Protection
13.1. The processing of personal data is carried out in accordance with the Law of Ukraine “On Personal Data Protection” No. 2297-VI dated 01.06.2010.
13.2. Personal data (name, phone number, email, address, payment information) are collected for the purposes of order processing and customer support.
13.3. Data are transferred only to delivery services and payment systems to the extent necessary for fulfilling the order.
13.4. The User has the right to request the modification or deletion of their personal data by sending an email to maltipooweb.23@gmail.com.
13.5. The Website uses cookies, Google Analytics, and Meta Pixel for analytical purposes. By using the Website, the User consents to the processing of cookies.
13.6. The Seller takes measures to protect personal data from unauthorized access.
